THE NHLPA.COM INSIDER AUTHENTIC GEAR GIVEAWAY CONTEST
OFFICIAL RULES AND REGULATIONS
The NHLPA.com Insider Authentic Gear Giveaway Contest (the “Contest”) is being operated and promoted by Hockey Ventures (Canada) Inc. (“Hockey Ventures”), a wholly-owned subsidiary of the National Hockey League Players’ Association (“NHLPA”).
Each Contest is open to legal residents of Canada (excluding residents of Québec) and the United States (excluding Puerto Rico and the U.S. Virgin Islands) thirteen (13) years of age or older at the time of entry and will be interpreted according to Canadian law.
Unless otherwise specified, Contest entries may be submitted on-line and received no later than 11:59 p.m. (EST) on March 30, 2012 (the “Contest Period”).
No purchase necessary. Void where prohibited by law.
1. ELIGIBILITY
Entrants must be legal residents of Canada (excluding residents of Québec) or the United States (excluding Puerto Rico and the U.S. Virgin Islands) and be thirteen (13) years of age or older at the time of entry. The following individuals are not eligible to enter the Contest: (i) employees, officers and directors of the NHLPA and Hockey Ventures; (ii) NHLPA members; (iii) employees, officers and directors of the NHLPA’s prize suppliers or advertising and promotional agencies; (iv) immediate family members of the individuals set out in (i) and (ii) above; and (v) all persons residing or domiciled with any individuals set out in(i), (ii) or (iii).
Entrants who are under the age of majority in his/her province of residence at the date of entry are eligible to enter the Contest and win the Prize provided that the parent or legal guardian of the entrant accepts any such prize and the terms and conditions hereof for and on behalf of such entrant.
2. ENTERING THE CONTEST
How to Enter: All eligible individuals who sign up for the Insider Newsletter will be automatically entered into the Contest. To sign up for the Insider Newsletter, go to www.nhlpa.com/social/insider-newsletter (the “Website”) and you will be prompted to (i) enter your first and last name, email address, date of birth, country and zip or postal code; (ii) check the tick-box acknowledging that you are agree to these Official Rules and the Privacy Policy; and (iii) click on the “SUBMIT” button.
By entering, entrants agree to comply with these Official Rules including all eligibility requirements. Illegible and/or incomplete Entries and Entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Hockey Ventures, the NHLPA and its agents are not responsible for lost, late, or misdirected Entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the Entries. Proof of entering information at Website does not constitute proof of delivery or receipt. Hockey Ventures reserves the right to modify the scheduling of the Contest without prior notification. Use of computer programs, macro, programmed, robotic, automatic and other similar means to enter the Contest is prohibited and may result in the disqualification of the entrant. In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the e-mail account is registered on the date the Entry is submitted. All Entries become the sole property of Hockey Ventures and will not be acknowledged or returned.
Additional Conditions of Entry: Participants may submit only one (1) entry per Contest Period and may not play with multiple e-mail address, nor use any other device to play multiple times or as multiple participants. Any participant who attempts to play with multiple e-mail addresses, under multiple identities, or uses any other device to play multiple times, may be disqualified.
Entries must be received during the time specified in these Official Rules. Neither the NHLPA nor Hockey Ventures is responsible for late, lost, delayed, damaged, misdirected, incomplete, void, corrupted, garbled, illegible, and/or unintelligible entries, or for any problems, bugs or malfunctions that entrants may encounter when submitting their entry. Only complete valid Entries will be accepted. Entrants must provide all information requested to be eligible to win. The NHLPA and Hockey Ventures reserve the right to disqualify false Entries or Entries suspected of being false. Incomplete, unreadable, or unintelligible Entries, in the discretion of the NHLPA and Hockey Ventures, will be disqualified. All Entries submitted become the property of Hockey Ventures and will not be acknowledged or returned.
By participating in the Contest, entrant warrants and represents that he or she complied in all respects with the requirements set out in these Official Rules.
3. PRIZE
One (1) NHLPA prize pack (the “Prize”) will be awarded to a participant who enters the Contest in accordance with the terms set out in these Official Rules. The Prize includes one authentic NHLPA jersey and one authentic NHLPA cap. The approximate retail value of the Prize is CDN$150.
Any items may bee added to the Prize at any time at the discretion of Hockey Ventures and/or the NHLPA. Such items will be posted on the Website.
At the discretion of Hockey Ventures and/or the NHLPA, the Prize may be substituted for comparable prize(s) that is/are of similar value. The Prize must be accepted as awarded. The Prize may not be sold, transferred and is not convertible to cash. All federal, state, provincial and local taxes associated with the receipt or use of any prize are the sole responsibility of the winner.
4. SELECTION OF WINNER
One winner will be chosen by a random computer drawing from among all eligible entrants who signed up for the Insider Newsletter during the Contest Period.
Potential winners will be required to correct answer, unassisted, a time-limited skill-testing mathematical question administered over the telephone at a mutually determined time prior to being awarded the Prize. If he/she fails to provide the correct answer, another potential Contest winner will be selected and the process will be repeated until a potential Contest winner successfully answers the skill-testing question and complies with the other requirements set out herein.
The odds of winning will depend on the number of eligible entries received.
5. NOTIFICATION OF WINNERS
A potential winner will be notified by telephone or email by March 9, 2012. A potential winner will be required to complete, sign and return an affidavit of eligibility and a liability and publicity release within ten (10) days of the prize notification in order to be eligible to receive the prize. If any prize is won by a minor, the minor’s parent or legal guardian must sign and return an affidavit of eligibility and a liability and publicity release and the prize will be awarded to the parent or legal guardian. If the prize is undeliverable or the prize remains unclaimed ten (10) days after the prize notification, an alternate winner will be selected.
Prizes will be dispatched as quickly as practicable and should be sent within approximately 1-2 weeks following the notification of winners.
It is the sole responsibility of each entrant to notify Hockey Ventures in writing if the entrant changes his/her email address or any other personal information contained in the entry application and/or username registration. 6. PUBLICITY
Except where prohibited by law, the names of the Prize winner will be published on www.nhlpa.com.
7. INDEMNITIES, DISCLAIMERS AND OTHER IMPORTANT TERMS
Indemnities: Entrant agrees to indemnify and hold the NHLPA, Hockey Ventures, and their respective affiliates, members, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the “Indemnitees”) harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnitees due to or arising out of the entrant’s entry in the Contest.
By participating in the Contest, entrants agree (i) and acknowledge that he or she has read these Rules and agrees to be bound by these Rules and any decisions of the NHLPA and Hockey Ventures relating to these Rules and/or the Contest, which shall be final and binding; and (ii) that if there is any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of these Rules shall prevail, govern and control.
All entrants agree to release and hold harmless the NHLPA, Hockey Ventures and their respective directors, members, employees, officers, licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production or administration of the Contest (collectively, the “Released Parties”), from and against any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and damage to property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a prize in the Contest, or their participation in the Contest, or their participation in the Contest. Each potential winner acknowledges that the Released Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize or the Contest. Apart from manufacturer warranties (which may not be available in all geographies), all warranties are hereby disclaimed; and each potential winner will accept the Prize “AS IS.”
Neither the NHLPA nor Hockey Ventures is responsible for any online entry lost, delayed, late, destroyed or misdirected due to technical problems or traffic congestion on the internet or at any website or any combination thereof. Neither the NHLPA nor Hockey Ventures assumes any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials-data that have been tampered with or altered are void. If for any reason, in the opinion of Hockey Ventures, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Hockey Ventures reserves their right to cancel, terminate, modify, amend, extend or suspend the Contest including canceling any method of entry, and select a winner from previously received eligible entries.
Neither the NHLPA, Hockey Ventures nor their respective directors, officers, employees, members, affiliates, partners, service providers, consultants, representatives or agents shall be held responsible for any errors or negligence that may arise or occur in connection with the Contest.
Personal Information: Contest is subject to all applicable federal, provincial and municipal laws and regulations. Personal information collected from entrants will be used by Hockey Ventures for the purpose of administering this Contest, awarding a prize and providing information via the Insider Newsletter. Neither the NHLPA nor Hockey Ventures will sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by them to fulfill the above purposes or as permitted or required by law. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in the Privacy Policy at www.nhlpa.com. Intellectual Property: All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the NHLPA and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
